General Terms of Business
1. Area of application of the General Terms of Business
The deliveries and achievements of the fa Herbie-Wheels occur exclusively on account of the following general terms of delivery and Terms of Business (Terms and Conditions) which are also obliging for future shops. Divergences of these Terms and Conditions, as well as orally dripped arrangements, are effective only after explicit written confirmation. With the order the ToB count as accepted.
2. Offer
The offers of the fa Herbie-Wheels are always not-binding. We are left to misprint, mistakes as well as changes in the design or those which arise on account of technical changes of our suppliers to us.
3. Prices and payment
All prices called in the on-line shop are gross prices , plus the forwarding expenses are calculated. The payment can occur only against cash in advance.
4. Dispatch kind and costs
The choice of the dispatch kind and the dispatch way is left to the salesclerk, provided that expressly something else was not agreed. By deliveries within Germany (without islands) the forwarding expenses of the German post of 7.00 nowadays (parcel to 5 kg) are attached as a base. The forwarding expenses for deliveries beyond Germany and the island regions are calculated after weight and goods value individually and should be asked in your own interest with us by telephone or E-Mail.
5. Delivery times
Find the delivery time article, itself in the camp (standard execution), approx. 1 week amounts, for special manufacture it is fixed the delivery time after telephone arrangement. The possibility of delivery of the articles offered in the on-line shop will expressly reserve, because we have no influence on supply shortages on the part of our suppliers.
6. Force majeure
Stepping the events one which hinder us in the delivery, but beyond our influence lie, the term of delivery is extended, until the obstacle exists no more. If the obstruction lasts longer than 6 months, the buyer is entitled to withdraw from the contract. Compensation claims are excluded. This also counts in case of from strike, shortage of raw materials and other operational disturbances which hinder us in the delivery unreasonably.
7. Guarantee
On all articles count the usual legal guarantee claims or terms of the manufacturer. Within the scope of the manufacturer's guarantee defective parts can be sent to us. The guarantee claims of the principal limit themselves to free substitute of faulty parts, as far as no own fault is. Defective parts can be sent at the end of the guarantee time against calculation of the amount of work involved directly to the fa Herbie-Wheels. Differences in the color representation are technically caused and do not entitle to the complaint of the product. Returns go at the expenses of the principal and must always occur "freely". Please, note that not free broadcastings cannot be accepted. For liability secondary damages and postsecondary damages at the company from and with our products we cannot be prosecuted, because a proper company or application cannot be supervised by us.
8. Goods taking back
The taking back of product in perfect state, unused and in packaging free of faults is possible basically any time if the delivery does not correspond to the ordered product. According to distant delivery law you have within 14 days an unlimited right of return of the ordered articles. Except from this are special manufactures. The postal date of receipt of your return is authoritative. Returns at the end of this time need our written approval. The product is "free" in general to send back. An acceptance of not free sent back goods is rejected. The repayment of the purchase price occurs with return (return) within 14 days and mängelfreiem state of the product by height of the goods value. With return at the end of 14 days we must calculate to you a handling charge of 15% of the goods value, at least however, 10.00 . If another product from our assortment is bought in the equivalent, this handling charge is cancelled, and merely the forwarding expenses (or forwarding expenses and surcharge) are calculated for the newly acquired article. From the exchange are excluded special manufactures.
9. Data protection
If you want to give up an order, we ask you for the passing on of confidential information as for example your names and address, your e-mail address or your telephone number. We assure you that your data are treated confidentially and these come exclusively within the scope of the business connection between you and the fa Herbie-Wheels for the use. The data are made to no outstanding third accessible or are sold into three parts.
10. Retention of title
We are left to retention of title up to the final and irrevocable payment entrance of all claims against the principal to us the property of the product.
11. Place of fulfilment and legal venue
place of fulfilment and legal venue for delivery and payment for both contracting partners is the seat of the fa Herbie-Wheels in Rülzheim (district court of Germersheim). German right counts to all legal issues. The preceding terms of business count exclusively to the on-line shop of Herbie-Wheels. If single clauses and parts of the clauses of these terms of business are invalid, all the other clauses remain valid.
